This notice applies to the websites komma.ch and kommacargo.ch, including their www versions (the Websites), operated by Komma AG, Via Losanna 4, 6900 Lugano, Switzerland. It explains how information about our vehicles, technology and services should be understood.
1 Website information
We aim to keep the Websites accurate and current. Their content provides general information about Komma and its activities. Unless expressly stated in a binding offer or agreement, it is not a contractual offer, a product warranty or a commitment to supply a particular vehicle, feature or service.
Information may change as development, testing, approval and commercial arrangements progress. Images, renderings and demonstration vehicles may show prototypes, optional equipment or configurations that differ from production vehicles. Where a product or feature is under development, its final specification and availability remain subject to completion of that process.
2 Technical specifications and comparisons
Specifications, range, speed, payload, energy consumption and other performance figures must be read together with the relevant model details, test methods and qualifications stated with them. Actual results depend on factors including configuration, load, route, traffic, weather, temperature, driving style, charging conditions and battery condition.
Productivity, operating-cost, total-cost-of-ownership and environmental comparisons are specific to their stated assumptions and scope. Trial results, simulations and estimates do not guarantee equivalent results for every customer or operation. Environmental comparisons depend on the lifecycle boundaries, energy mix, usage period and comparator selected. Please contact us for the supporting methodology or to assess suitability for your operation.
3 Approval and permitted use
Road registration, driving-licence and helmet requirements, motorway access, parking and access to pedestrian, restricted or low-emission areas depend on the vehicle category, model approval, country and local rules. A vehicle’s dimensions or physical capability do not in themselves confer a right of access. Users must hold the required licence and comply with applicable rules, restrictions and permits. References to a standard car licence or road access must be read subject to these conditions.
4 Availability and services
Vehicle availability, demonstrations, delivery schedules, leasing, servicing, replacement vehicles, connectivity, telematics and software support depend on the relevant market, configuration, availability and agreed terms. Planned services or development objectives are not commitments unless expressly incorporated into an agreement.
Any leasing or other third-party offering is subject to the relevant provider’s eligibility requirements, approval and contractual terms. A partnership reference does not make Komma the lender, lessor or guarantor. The duration, scope and cost of software updates and connected services will be specified in the applicable offer or agreement, subject to mandatory legal obligations.
5 Enquiries and existing rights
Submitting an enquiry, expressing interest or requesting a demonstration does not place an order, reserve a vehicle, secure a delivery position or create a purchase or leasing obligation. Demonstrations require separate confirmation and may be subject to participation conditions.
This notice does not amend an existing agreement or remove rights already acquired under a reservation, programme, purchase or other contract. Specific binding terms and mandatory law prevail over inconsistent general website information.
6 Responsibility and contact
Nothing in this notice excludes liability for intentional misconduct, gross negligence, fraud, or any liability or rights that cannot lawfully be excluded, including mandatory product-liability and consumer protections. Website use is also addressed in our Website Terms and Conditions.
