Website Terms and Conditions

Komma AG | komma.ch and kommacargo.ch

Effective date: 14.09.2026

These terms govern use of komma.ch and kommacargo.ch, including their www versions (the Websites). Both Websites are operated by Komma AG, Via Losanna 4, 6900 Lugano, Switzerland (Komma, we, us). Our contact address is info@komma.ch.

1 Scope of these terms

The Websites provide information about Komma, our vehicles and services, and allow visitors to contact us. These terms concern website use only. They do not constitute terms of sale, leasing, reservation, vehicle hire, demonstration participation or connected services. Such transactions require the applicable separate terms and an agreement with the relevant contracting party.

Where contractual acceptance is required for a particular service, the applicable terms will be provided before acceptance. Browsing the Websites or submitting an ordinary enquiry does not itself create a purchase, leasing or reservation agreement. Mandatory statutory rights remain unaffected.

2 Enquiries and demonstrations

Information you submit must be accurate to the best of your knowledge and relevant to your enquiry. If you act for an organisation, identify your role accurately. You must have authority before making a binding commitment on its behalf.

A request for a demonstration or a registration of interest is non-binding and subject to our confirmation. It does not guarantee a vehicle, appointment, allocation, price or delivery date. Any requirements concerning age, driving licence, insurance or safe participation will be communicated for the relevant activity.

Do not submit sensitive personal information or confidential third-party material through a general enquiry form unless we have agreed an appropriate channel. Submitting material does not transfer ownership of it to Komma; we may use it as necessary to handle your request and as explained in our Data Protection Policy.

3 Permitted website use

You may use the Websites for lawful purposes and view or download publicly available materials for your own information or internal business evaluation, subject to any specific conditions stated with those materials. Keep copyright and other proprietary notices intact.

You must not interfere with website operation, introduce malicious code, attempt unauthorised access, impersonate another person, submit unlawful content, or use automated access in a way that disrupts the Websites or infringes others’ rights. We may take proportionate steps to prevent misuse or protect security, including restricting access where justified.

4 Intellectual property

Unless otherwise indicated, rights in the Websites and their text, images, designs, drawings, software, trade marks and other content belong to Komma or the relevant rights holders. Except as expressly permitted by these terms, applicable law or the rights holder, you may not reproduce, distribute, modify or commercially exploit that content.

References to third-party brands or organisations do not confer a licence to use their intellectual property. Nothing on the Websites grants rights in Komma’s vehicle designs, patents, trade marks or technology.

5 Product information and external services

Product specifications, comparisons and availability are subject to the qualifications explained with the relevant information and in our Website and Product Disclaimer. The Disclaimer forms part of these website terms to the extent applicable and validly incorporated. It does not override an express contractual commitment or mandatory rights.

Links to external websites or services are provided for convenience or information. Those resources are operated by their respective providers and are subject to their own terms and privacy information. A link alone does not imply endorsement. An expressly identified partnership is limited to its stated scope.

6 Availability and liability

We take reasonable care in operating the Websites but do not guarantee uninterrupted availability, freedom from technical errors or that every item of general information is complete and current. Access may be interrupted for maintenance, updates, security measures or reasons beyond our reasonable control.

To the extent permitted by law, Komma excludes liability for loss arising from ordinary negligence in connection with access to or use of the Websites or reliance on their general information, including indirect or consequential loss and loss of profit, revenue, opportunity or data.

These limitations do not apply to intentional misconduct, gross negligence, fraud or liability that cannot lawfully be excluded or limited. They do not restrict mandatory product-liability, personal-injury, data-protection or consumer rights. Liability under a separate agreement is governed by that agreement and applicable law.

7 Personal data

Our Data Protection Policy explains how we process personal data in connection with both Websites and related communications. It is available through the footer of each Website. An enquiry does not automatically subscribe you to marketing. Where consent is required, it is requested separately and may be withdrawn.

8 Changes and discontinued offers

We may update these website terms prospectively by publishing a revised version with its effective date. Where an existing contractual relationship requires notice or agreement to a change, we will provide that notice or obtain that agreement as required. Publication alone does not amend separate agreements.

A programme or offer that is expressly marked as closed is not open for new participation. Its closure, removal from the Websites or replacement by a new offer does not itself extinguish rights or obligations arising from earlier participation. Those are governed by the relevant original terms and any valid subsequent agreement.

9 Governing law and jurisdiction

These website terms are governed by substantive Swiss law, subject to any mandatory protections applicable to you. To the extent a choice of court is legally valid and these terms have been validly agreed, the competent courts in Lugano, Switzerland shall have exclusive jurisdiction over disputes arising from them. Mandatory jurisdiction rules, including those protecting consumers and data subjects, remain unaffected.
